The Corruption Prevention Regime in Portugal: companies with more than 50 employees
The RGPC Platform, launched by the National Anti-Corruption Mechanism (MENAC) and through which companies covered by the general regime for the prevention of corruption (RGPC), approved in the annex to Decree-Law no. 109-E/2021, of 9 December, must submit the various documents relating to the Regulatory Compliance Programme, went live on 25 November. Registration on the RGPC Platform and the submission of all documents must be completed by 31 December 2024.
Note that the entities covered are those with more than 50 employees who are:
- Companies with their head office in Portugal or
- Branches in Portugal of companies with their head office abroad
And these entities are obliged to implement a Compliance Programme which comprises:
- a plan to prevent risks of corruption and related offences;
- a code of conduct;
- a training programme;
- a whistleblowing channel;
- a compliance officer; and
- a system for evaluating the Programme.
The fines applicable in the event of non-compliance can be up to €3,740.98 for natural persons and between €1,000 and €44,891.81 for legal persons.
