New Temporary Measures on Local Accommodation
The new temporary and extraordinary regime that aims to support municipalities in the regulation of local accommodation activity comes into force today, with application until 31 December 2026.
Decree-Law No. 151/2026, of July 30, responds to the challenges experienced by municipalities in meeting the legal deadlines to approve or amend municipal regulations for local accommodation, as well as to manage, in an articulated way, the suspension of new registrations in their territory.
Thus, municipalities that, by 31 December 2025, have exceeded 1,000 registrations of local accommodation establishments must deliberate, by 31 December 2026, on the exercise of their regulatory power in relation to the local accommodation activity, if they have not already done so.
As for the suspensions already decreed, they may, exceptionally and for a single time, be extended (if still in force) or renewed (if they have ceased), for the period strictly necessary for the preparation or amendment of the applicable municipal regulations.
It should be noted that the extensions and renewals of suspensions determined under this regime automatically expire with the occurrence of one of the following situations:
- Entry into force of the municipal regulation of local accommodation or its amendment; or
- Express resolution of the municipal assembly that determines the end of the suspension; or
- Expiry of the period established, specifically, for the extension or for the new suspension; or
- Deadline of 31 December 2026.
